Fees & Expenses
I will work on your personal injury case on a contingent or percentage fee basis. If you hire me to represent you and I settle your case without filing a lawsuit, my fee is 30% of the gross recovery. If a lawsuit is filed but settled before significant trial preparations have begun, my fee is 35% of the gross recovery. And, if significant trial preparations have begun and/or the case is tried to verdict, my fee is 40% of the gross verdict. If there is no recovery, there is no attorney fee.
I will from time to time advance those expenses necessary to protect and pursue your interests in the case. You agree to reimburse me for those advancements from the proceeds of your settlement or verdict after the payment of any attorney fee. If there is no recovery, you still may be responsible for advancements.

Insurance Adjusters - What you should know
Insurance adjusters are not your friends. They work for the insurance company, and they are 100% focused on paying you as little as possible. The adjuster from the other side’s insurance company may be very pleasant, appear genuinely concerned and even try to be your friend. In “real life” he or she may be a wonderful person, coach a little league team, and be active in community associations. But always remember his or her job is to protect the insurance company, to find a reason NOT to pay you, or if they must, to make sure you recieve as little as the insurance company can possibly get away with, and ideally, to try to “make the matter go away". Most adjusters are taught that the best way to make a case go away is to control the claimant - you! They do this by being friendly, or by being mean, depending on what they think will work best on a given individual.
The adjuster may try to get you to minimize the nature and extent of your pain, the impact of any permanent injury, or try to get you to accept full or partial responsibility for the accident when it was not your fault ("I guess you should have paid more attention…"). In addition, they may tell you how difficult it would be to recover more for your injuries ("If I were you I’d accept this. You’ll never get more from a jury and besides the courts have a 3 year back-up…"). And, they may try to discourage you from hiring a lawyer ("By the time you pay a lawyer you’ll end up with no more than if you just take this today…"). NONSENSE! Those are classic insurance adjuster tricks that should be ignored.
Insurance adjusters are professional negotiators with extensive experience in intimidation, “hassling", and using every psychological technique to manuever you into settling for the lowest possible dollar, including discouraging people from using the professional services of a lawyer. Adjusters know that if they can keep you negotiating, there is a high probability of a successful settlement in favor of the insurance company. You can’t beat the experts at thier game. Don’t try it.

FAQ
What is a counterclaim? A claim that the defendant in a suit has against the plaintiff from the same transaction.
What are punitive damages? Damages awarded to punish the defendant.
What is negligence? A failure to act reasonably in a situation. Doing something carelessly or failing to do something.
What does pain and suffering include? This would generally be money awarded over and above medical costs and wages.
What is loss of consortium? A loss of companionship and care for the victim’s marital partner.
Will my case end up at trial? Only about 25% of all personal injury cases end in court. Most settle out of court.
What is litigation? A law suit.
What is the statute of limitations? Generally two years from the date the accident or incident occurred.
What is emotional distress? Mental anguish.
What is a tort? Conduct intended to harm another person or their property.
What is civil law? Principles that govern relationships between people where no crime has been committed.
